1. Who we are

Aerolex (“Aerolex”, “we”, “us”, or “our”) is a sole trader established in Malta, operating the website aerolex.com (the “Site”). Aerolex is committed to protecting the privacy of individuals who interact with the Site, and this Privacy Policy explains how we collect, use, and protect your personal information.

For the purposes of Regulation (EU) 2016/679 (the “GDPR”) and the Maltese Data Protection Act (Cap. 586) (together, the “Data Protection Legislation”), Aerolex is the data controller in respect of personal information collected through the Site.

2. What personal information we collect and how we collect it

We collect personal information that you provide to us directly, including when you:

• Submit an enquiry through the contact form on the Site;
• Subscribe to receive email updates or newsletters from us; or
• Contact us directly by email.

The personal information we collect may include your name, email address, and the content of any message or enquiry you send us.

The Site does not process payments, and we do not currently collect financial or payment card information.

The Site may use cookies and similar technologies that are strictly necessary for its basic operation (for example, to process a contact form submission). 4. Legal basis for collecting and using your personal information

The Data Protection Legislation requires that personal information is only used where there is a lawful basis to do so. Aerolex relies on the following grounds:

• Consent — where you subscribe to our newsletter or otherwise opt in to marketing communications. You may withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
• Legitimate interests — to respond to enquiries submitted through the contact form, to maintain records of correspondence, and to ensure the security and proper functioning of the Site. We have assessed that these interests do not override your rights and freedoms.
• Legal obligation — where necessary to comply with Maltese tax, accounting, or other statutory record-keeping obligations.

5. How we use your personal information

• To respond to and manage enquiries submitted via the contact form;
• To send newsletter or marketing communications, where you have opted in;
• To maintain records of correspondence;
• To monitor and maintain the security and performance of the Site; and
• To comply with applicable legal or regulatory obligations.

We do not sell, rent, or trade your personal information to third parties.

6. Automated processing of your personal data, including profiling

Aerolex does not carry out any automated decision-making or profiling using the personal data we collect.

7. Data retention, security and international transfers

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, taking into account our need to respond to enquiries, comply with legal obligations (including Maltese tax and accounting record-keeping requirements), and resolve any disputes. Newsletter subscriber information is retained until you unsubscribe or withdraw consent.

We take reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, misuse, or alteration. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

Where we use third-party service providers to operate the Site or manage communications (for example, website hosting or email/newsletter delivery services), your personal information may be processed on servers located outside Malta and the European Economic Area (“EEA”), including in countries that have not been assessed by the European Commission as providing an adequate level of protection. Where this occurs, we take reasonable steps to ensure appropriate safeguards are in place, such as reliance on the European Commission’s Standard Contractual Clauses or another legally recognised transfer mechanism.

The Site is hosted using infrastructure provided by Hetzner Online GmbH, with the relevant website hosting infrastructure located in Germany. Germany is a member of the European Economic Area (“EEA”), and personal information processed through the Site’s hosting infrastructure is therefore processed within the EEA. Hetzner may process personal information on our behalf as a data processor, where applicable, in accordance with applicable data protection laws and our contractual arrangements with the provider.

8. Your rights

Under the Data Protection Legislation, you have the right to:

• Access the personal information we hold about you;
• Request correction of inaccurate or incomplete personal information;
• Request erasure of your personal information, where there is no legal ground for us to continue holding it;
• Request restriction of our processing of your personal information;
• Object to our processing of your personal information, including for direct marketing purposes;
• Request that we transfer your personal information to a third party (data portability); and
• Withdraw your consent at any time, where processing is based on consent.

9. How to unsubscribe

If you have subscribed to receive newsletter or marketing communications from us and wish to unsubscribe at any time, you may click the “unsubscribe” link included in any such email, or contact us directly using the details in Section 11.

10. Children’s privacy

The Site is not directed at, and we do not knowingly collect personal information from, children under the age of 16. If you believe a child has provided us with personal information, please contact us so that we can take appropriate action.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. Where we make material changes, we will provide notice on the Site. Your continued use of the Site following any changes constitutes acceptance of the updated Privacy Policy.
